International Human Rights Strategy for Extradition Detention

Extradition detention can raise human rights concerns when judicial control is ineffective, the detention becomes disproportionate or the person is held without an adequate legal basis. But WGAD cannot cancel an extradition request, grant bail under national law or substitute for a court with jurisdiction over surrender.

Why this matters

International analysis must separate the lawfulness of custody from the merits of extradition, refugee status, INTERPOL data and any risk of torture on transfer. Those are related issues but involve distinct procedural safeguards and decision-makers.

How we approach the issue

We help the existing defence team evaluate liberty concerns, identify relevant court records and determine whether a WGAD petition or another international mechanism adds concrete value.

An individual can be lawfully arrested under an extradition statute yet still have an arguable human-rights claim concerning the length, justification or review of the custody. The receiving State's duty to process the extradition request diligently is distinct from the merits of the criminal allegations made by the requesting State. An international detention review therefore examines the State actually holding the person and the safeguards available there.

Separate detention, extradition and non-refoulement arguments

Detention pending extradition concerns liberty and procedural safeguards. The extradition case itself concerns whether surrender is legally permissible. A non-refoulement argument concerns risk on return—for example torture or other serious harm—and may engage different domestic and international procedures. Those are related but not interchangeable. A successful challenge on one question does not automatically decide the others.

Scenario Primary question Evidence source
Months in custody awaiting documents Has the case progressed with due diligence? Hearing chronology and correspondence
Automatic detention without individual reasons Were alternatives considered? Bail and custody decisions
Repeated adjournments Who caused the delays and why? Court minutes and applications
Serious risk on surrender Is non-refoulement protection engaged? Country evidence and individual risk record
INTERPOL notice cited as basis for arrest What domestic authority permits custody? Arrest warrant, extradition file, notice documentation

Coordination across jurisdictions

Defence counsel in the custodial State should lead bail and extradition litigation, while other lawyers may address the requesting State's criminal file or relevant INTERPOL data. An international human-rights researcher can document arbitrary detention concerns, but should not promise that a WGAD communication will suspend an extradition warrant or override an INTERPOL or court decision.

Case review checklist

  1. Identify the State holding the person and the legal basis for custody.
  2. Separate custody dates from the progress of extradition proceedings.
  3. Read every judicial review or bail decision rather than relying on summaries.
  4. Check whether removal or transfer is imminent and whether local protective remedies exist.
  5. Assess distinct liberty, fair-trial and non-refoulement issues and their forums.

The site should refer a person facing immediate surrender to qualified local extradition counsel rather than suggesting that an international petition alone creates a stay.

Practical actions and evidence checklist

  • Review detention orders, renewal decisions and hearing dates
  • Evaluate effective access to judicial review
  • Assess detention duration, necessity and alternatives
  • Identify potentially separate non-refoulement and fair-trial questions
  • Coordinate evidence with extradition counsel

Frequently asked questions

Can a WGAD opinion stop extradition?

No automatic legal stay follows from an opinion. Relevant local procedures are critical.

Is a Red Notice an arrest warrant?

An INTERPOL Red Notice is not itself an international arrest warrant. National law determines arrest and detention powers.

Should we file urgently?

Urgency depends on verified imminent harm and available remedies, not solely on an approaching court date.

Request a case assessment

Provide the custodial State, the requesting State, the current extradition hearing stage and imminent deadlines. Immediate domestic applications should be handled by qualified local extradition counsel. Request an international detention review.
