Evidence Development for Arbitrary Detention Cases

International complaints depend on accurate facts: who detained the person, under what authority, when judicial review occurred and how the deprivation of liberty continued. A petition can be weakened by an inconsistent chronology, unverified translations or unsupported claims of political motive.

Why this matters

Evidence work must never mean manufacturing a new fact. It means identifying an existing fact, locating a reliable source, obtaining it lawfully and explaining why it matters. Local counsel is often needed to access certified case files or clarify the status of national proceedings.

How we approach the issue

We design an evidence plan with responsibilities, provenance notes, document authenticity checks and a clear relation between every proposed legal ground and its supporting material.

Building a defensible evidence record

Evidence development is often the difference between a compelling story and a submission another institution can evaluate. The objective is not to “create” evidence but to find, lawfully obtain, authenticate, preserve and accurately explain material that already exists. An advocate must never manufacture witness statements, alter court records or ask someone to sign a narrative they cannot independently confirm.

Source hierarchy and attribution

A certified court order is not equivalent to a forwarded screenshot of an unidentified message. A first-hand witness account has different strengths and weaknesses from a press report. The file should preserve origin, date, language, custodian and whether a document is a full copy or an extract. Contradictory documents belong in the analysis, not in a hidden folder.

Building the chronology

Detention records may use different date formats, time zones or transliterations of names. A chronology should clearly separate the date an event occurred, the date the source learned about it and the date the supporting document was issued. This matters when reconstructing unlawful periods of detention or conflicting orders.

Evidence quality control

Material Verification questions Common risk
Court ruling Court, docket, issuance, operative part, finality Quoting a draft or incomplete extract
Prison / custody register Authorised issuer, dates, corrections Unexplained custody gap
Witness statement First-hand knowledge, date, safe consent Coaching or identity exposure
Medical evidence Author, date, clinical significance Publishing unnecessary sensitive detail
Digital file Origin, metadata, chain of custody Cropped screenshot with no context
Government correspondence Sender, reference, service evidence Treating an unanswered request as a finding

Cross-border documentation challenges

Where documents must be obtained in another jurisdiction, local counsel may be needed for formal access, certified copies and lawful translation. A refusal to disclose a file should itself be recorded accurately; it is not permission to invent the missing content. When an authority's position changes, retain the original and later versions and document the sequence.

Deliverables that can be independently checked

  1. An indexed document inventory with preservation notes.
  2. A chronology with source citations for each material event.
  3. A discrepancy log identifying gaps and conflicting evidence.
  4. Translation status and an authenticity-check plan.
  5. A short memorandum distinguishing facts from inferences and legal submissions.

The assessment may find that the evidence is insufficient to support one WGAD category while supporting another. The point of disciplined evidence work is to improve accuracy, not to guarantee a favourable opinion.

Practical actions and evidence checklist

  • Create an events timeline with dated source references
  • Identify missing detention orders and judicial-review records
  • Coordinate lawful document access with local attorneys
  • Verify translations, author names and documentary provenance
  • Prepare an indexed annex package and uncertainty register
Evidence type Use Caution
Detention order Shows stated basis and custody duration May omit later extensions
Court transcript Documents procedural safeguards and objections Incomplete transcript can distort context
Medical report Documents condition in custody Requires secure sensitive-data handling
Official correspondence Shows request/response timeline Verify authority and date
Witness statement Supports disputed events Separate firsthand facts from inference

Frequently asked questions

Can you obtain secret police files?

We do not promise access to confidential state material. All document acquisition must be lawful and jurisdiction-appropriate.

Can a witness statement replace a court decision?

It may support particular facts but does not necessarily establish the legal status of proceedings.

Do you need original documents?

Authentic official copies and provenance are preferable; exact needs depend on the procedure and case.

Do translations require certification?

Some national processes have specific requirements. International submissions benefit from accurate translations with clear source references.

Request a case assessment

Tell us which custody, court or administrative records are missing and in which jurisdiction they may be held. We can assess whether a document-verification and lawful collection plan is appropriate. Request an evidence review.
